Alert: 2009-2010 SPCC Rule Change: EPA's 2009 SPCC Rule Revisions

The EPA recently amended the Spill Prevention, Control, and Countermeasure (SPCC) requirements.   Several exemptions have been removed—meaning more businesses are now required to comply under the SPCC Plan Rule! No longer is it “if” you are impacted but “how”you are affected.

Simply stated, the new regulation requires more facilities to address the prevention, containment, and/or cleanup of oil spills.

But there is also a change that allows you to revisit and establish your own security measures – potentially saving you money!   Under the new amendment you are allowed to develop a customized security plan– you are no longer obligated to use prescribed measures under prior amendments.

This rule is effective January 14, 2010.
